DHA welcomes the New Year with Inspector's decision
Approval at appeal received on behalf of Bellway Homes for development site in Otham.
DHA are delighted to have recently secured permission at appeal for the development of land at Church Road in Otham, Kent. The Inspector's decision approving (with costs) the outline permission for 440 dwellings and the detailed planning application for 421 dwellings was received in the New Year following the virtual hearing held at the end of 2020.
This is a fantastic and quick decision for our clients, Bellway Homes, with DHA not only hosting the Inquiry appellant team (in a COVID-secure space), but with Matthew Woodhead giving the planning evidence and Paul Lulham the highways evidence, also assisted by DHA's Rebecca Foad, Hannah Atkins and Chris Smoker. A useful decision too and case law for anyone dealing with the test of severity and Paragraph 109 of the NPPF.
The team consisted of Bellway Homes, Hashi Mohamed as Counsel, law firm Charles Russell Speechlys, Heritage Collective UK Ltd, Herrington Consulting Ltd, OSP Architecture, Horton Strategic and environmental consultants, Phlorum.
Chris Moore, Managing Director at Bellway Homes said: "A very big thank you to you all for your collective hard work, focus and professionalism in winning this appeal. The manner in which you all collectively dealt with whatever was thrown in front of us was both very professional and diligent and a credit to you all. Thank you for all of your efforts."
