dha planning secures Certificate of Lawful Use for non-compliance with agricultural occupancy condition


dha have secured a Certificate of Lawful Use which confirmed that a dwelling house had been occupied for a period of ten years or more without compliance with an agricultural occupancy condition at Riverfield Fish Farm, Marden. The agricultural occupancy condition required that the house was occupied by someone employed in agriculture.

dha successfully argued that Riverfield Fish Farm is used for the production of fish for angling purposes, which does not fall into the definition of agriculture. Evidence was submitted with the application to confirm that the site had not been used for agricultural purposes for ten years and that the sole occupation of the occupiers of the house was non-agricultural.The agricultural tie to the dwelling is therefore removed from the house by virtue of the approval of the Certificate of Lawful Use.
