Smaller schemes set to be exempt from affordable housing and contributions once again?
The Court of Appeal has today overturned last year’s High Court decision which had ripped up a Government policy exempting small developments from providing affordable housing and paying development contributions. The policy was originally introduced to the National Planning Practice Guidance (NPPG) last year, only to be removed following a successful legal challenge by West Berkshire District Council and Reading Borough Council, as reported by dha last summer.
It is expected that today’s decision will result in the relevant paragraphs of the NPPG being reinstated although the Government has not yet confirmed this. If so, developments of 10 or fewer units will, once again, no longer have to provide affordable housing or pay development contributions.
