The Department for Levelling Up, Housing and Communities have recently started a consultation regarding the proposed introduction of a Use Class for short term lets, as well as the introduction of new Permitted Development Rights for such use. The consultation seeks views on:

 

  • Introduction of a short term let use class.
  • Introduction of new Permitted Development rights to allow the change of use from a dwellinghouse to short term let and vice versa.
  • How a flexibility to homeowners to let out their dwellings for a number for 30 nights in a calendar year could be provided through either changes to the dwellinghouse use class or an additional permitted development right.
  • Introduction of a planning application fee for the development of new build short term lets.

 

Whilst DLUHC note the importance short term lets have in supporting tourism and the local economy in rural areas, the consultation does consider that the number of short term lets in certain areas (such as coastal towns, national parks, cities and other areas of interest) can impact on the availability and affordability of homes to buy or rent for local people, as well as impact the sustainability of the community.
 
The consultation follows on from a recent House of Commons briefing paper, which estimates that 148,000 properties in England were being used for short term lettings in September 2021 via online platforms, and more specifically short-term lettings had increase by 661% in Cornwall in the 5 years to September 2021. The Briefing Paper also highlights an increase in the popularity of AirBnB, with a 33% increase in listings between 2017 and 2018.
 
The consultation closes at 11:45pm on 7th June 2023.
